These Terms of Service ("Terms") govern your access to and use of the O'Brien Custom Homes website ("Site") and services ("Services"). 1. Services Provided

O'Brien Custom Homes specializes in custom home design and construction. Our services are delivered according to project-specific agreements and contracts, which outline the scope of work, timelines, and payment terms.

2. Use of the Site

You agree to use our Site only for lawful purposes and in compliance with these Terms. You are prohibited from:

Violating any local, state, or federal laws or regulations.
Impersonating or attempting to impersonate O'Brien Custom Homes, its employees, or any other entity.

All construction and home design services provided by O'Brien Custom Homes are subject to written agreements or contracts. These agreements will outline:

Payment terms.
Client responsibilities.

Any changes to the scope or terms must be agreed upon in writing by both parties.

5. Payment Terms

Clients are required to follow the payment terms outlined in their specific project agreement.

Additional fees may apply for revisions or changes requested after the agreement is signed.

Failure to make timely payments may result in delays or termination of the project. Late payments may incur additional fees.

6. Refund Policy

Due to the custom nature of our home design and construction services, refunds are generally not provided. In the event a project is canceled or terminated, any refunds will be considered based on the amount of work completed at the time of termination and will be outlined in the project agreement.

7. Revisions and Changes

Clients are entitled to a certain number of revisions as detailed in the project agreement. Additional revisions beyond what is included in the agreement will be billed at an hourly rate, which will be specified in the agreement.

8. Limitation of Liability

To the fullest extent permitted by law, O'Brien Custom Homes will not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your use of our Site or Services, even if we have been advised of such damages.

9. Termination of Services

O'Brien Custom Homes reserves the right to terminate or suspend access to the Site or Services at its sole discretion, without notice, if it believes a user has violated these Terms or engaged in unlawful activity.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal actions arising out of or related to these Terms must be brought in the state or federal courts located in Texas.
